Who you are dealing with, where we are, and how to reach a person.

Anyone who runs a site that sells has to say who they are. Article 5 of Directive 2000/31/EC and чл. 4 от Закона за електронната търговия both require a name, a geographic address and a way to reach a person, easily, directly and permanently accessible. This page is that, and every page on the site links to it from the footer.

The postal address is the one line still to be added here. It is required and it is not something a website can invent, so rather than print a plausible street this says that it is outstanding. Ask for it by e-mail in the meantime and you will be given it.
Who takes your money
{{Provider:legal}} is the merchant of record for everything sold here. That is a specific arrangement and not a payment button with a logo on it. It means:
- the payment contract is concluded with them, not with DATUM;
- they charge and remit VAT at the rate of your own country, under their own registration, and show you the exact figure before you pay;
- the receipt or invoice comes from them and carries their name, which is why it will not say DATUM — that is normal and it is a valid document;
- they issue and deliver your licence key along with the download.
DATUM makes the templates and the plugins, licenses them to you, and answers for whether they do what their pages say. Where these two roles meet, each answers for its own part — and you may bring a complaint to us either way rather than being sent back and forth. Section 1 of the Terms of sale sets that out.
What a merchant of record does not do is stand in for the identity of the site. The duty in чл. 4 ЗЕТ is on whoever operates the shop and offers the products, and that is DATUM. It is discharged by the table above, not by naming a payment provider.
Selling as a person rather than a company
There is no ЕООД behind DATUM and the table says so. That is a lawful way to answer Article 5 — it asks for a registration number from those who have one, and does not require anyone to acquire one — and it is stated here plainly rather than left as a gap for a reader to wonder about.
Two things it does not change, said here because a customer is entitled to know who they are dealing with and on what footing:
- Liability is personal. Without a limited company there is no company to sit between a claim and the person. That is a risk carried by us, not by you, and it is worth knowing that it is carried rather than passed on.
- It may not stay this way. Bulgarian law expects a business carried on systematically to be registered, and the point at which a shop crosses that line is a question for an accountant. If DATUM registers, this page changes on the day it does and your existing licence is unaffected.
Complaints, and who supervises this
Write to support@datumbim.com first — almost everything ends there, and the refunds page sets out what you are entitled to before you have to ask for it.
If that fails: the authority for consumer matters in Bulgaria is the Commission for Consumer Protection (Комисия за защита на потребителите, kzp.bg), which also runs the conciliation commissions used for alternative dispute resolution. For personal data it is the Commission for Personal Data Protection (Комисия за защита на личните данни, cpdp.bg). You may go to either without coming to us first, though we would rather you told us.
Selling Revit templates and add-ins is not a regulated profession. There is no licence or authorisation behind it and DATUM claims membership of no professional body in that capacity.

The DATUM Revit templates (.rte), the families that come with them (.rfa), the DATUM BIM add-in — its compiled files, its installer and its source code — and the manual are protected works under the Закон за авторското право и сродните му права and the Berne Convention. They are DATUM's own work, or are used under a licence that permits it. Protection arises the moment a work is made; nothing has to be registered for it to apply.
Buying one gives you a licence to use it, not ownership of it. What that licence allows is set out in the Terms and conditions. Copying, sharing, reselling or republishing any of it, whole or in part, beyond what the licence allows needs written permission first.
That sits on top of the law and never in place of it. A lawful user of the add-in keeps the rights that Articles 5(2), 5(3) and 6 of Directive 2009/24/EC give them and that no contract can take away: to make a back-up copy, to observe and study how the program works, and to decompile it where that is indispensable for interoperability with other software.
